H1B Visa (Work Visa) and You

The Covid-19 Pandemic of 2020 has hit the world economy hard and no country has been spared, some more than others. One of the worst-hit in the USA where it seeing one of its worst recessions in decades. This has prompted their head of state to put a hold on H1B visas till the end of the year (around December) impacting thousands planning to work in the USA and their future. 

What exactly is the American H1B Visa (Work Visa) the world is talking about and everyone wants? Well putting it simply is a work-based visa issued by the American government for non-immigrant, temporary workers or professionals. For any person to get such a visa, the employer who is offering the position and must apply for the H1B visa petition with the US Immigration Department. This approved petition is a work permit that allows a working professional to obtain a visa stamp and work in America for that particular business. 

To be eligible for this particular visa, one has to be proficient in a specialist occupation which requires theoretical and practical knowledge in a domain/industry and the minimum qualification for to get such a visa is at least a bachelor's degree from a recognized school of higher learning. In short, one has to be a white-collar worker to get eligible for such a degree such as that in information-technology or IT in short, of which there is a big demand in the USA with leading tech companies such as Google, Microsoft, TCS, and Wipro, and so on.   

Every year to meet the demand from the industries, the government issues a quota under which the H1B Visa (Work Visa) is issued. The numbers vary every year but historically the sealing has been 65000 per year. A deadline is set every year within which businesses are expected to have filed for their H1B visa petitions meant for the next financial year. Thereafter no new applications can be submitted. Since there is a big rush from around the world and many businesses, the quota is full within a few days of the opening of the applications. So the saying “early bird gets the worm” applies in this case very appropriately. 

As per the visa, a worker can stay in the USA for a 3-year period which can be extended up to a maximum of 6 years. If there has been an extension granted to a particular person, re-stamping can be done on the passport from any American consulate in any other country rather than returning to your home country to get it done.

This is a multiple entry visa and Family Status allows the spouse and unmarried children (under the age of 21) of H1B professionals to stay in America under a dependent category called the H4 visa for the same period as the H1B status. And yes, holders H1B visas are eligible to apply for permanent residency of the country also known as getting a green card.  A vital note - H1B visa can be transferred to a new employer.
